Terms and Conditions of Lúmina Travel

At Lúmina Travel, we are dedicated to creating unique and memorable travel experiences. These terms and conditions govern the use of our services and the relationship between Lúmina Travel and its clients. By using our services, you agree to these terms.

1. Scope of Services

Lúmina Travel offers a variety of personalized services to design, plan, and coordinate trips. These include creating custom itineraries, managing accommodation bookings, transfers, flights, activities, and more, depending on the package selected. The services provided are subject to availability and the provider's terms and may be subject to changes based on the client's needs and feasibility.

2. Rates, Payments, Changes, and Cancellations

2.1 Initial Rates

  • Planning Fee: $100 USD. This fee is non-refundable but will be credited towards the total cost of the trip.

  • Total Cost: Includes all travel elements such as fees, vendor rates, taxes, and the services mentioned in the itinerary inclusions.

2.2 Rates and Payments

  • To confirm a reservation, a non-refundable deposit in USD is required.

  • If payment is not completed, Lúmina Travel reserves the right to cancel the booking without refunds.

  • Payments must be made in USD at the exchange rate of the day, via bank transfer or payment link.

  • Delayed payments may result in additional costs, such as increased rates or changes in the reservation due to availability.

2.3 Accommodation Policy

  • In case of changes to accommodation, the change will be within the same category or a higher category.

  • Hotel categories may vary according to the standards of the destination country.

2.4 Change Policy

Any change request must be made directly with Lúmina Travel. Once the corresponding additional cost is accepted, we will proceed with the modifications, as long as they are feasible. Lúmina Travel reserves the right to reject changes based on their feasibility or complexity.
Fees after the two batches of changes in the service have been used:

    • Before the trip starts:

      • Tours and activities: $25 USD per change.

      • Transfers and accommodations: $50 USD per change.

      • Change of destination: $200 USD per change.

    • During the trip:

      • Tours and activities: $50 USD per change.

      • Transfers and accommodations: $100 USD per change.

      • Change of destination: $400 USD per change.

  • In addition to Lúmina Travel’s fees, the vendor may apply additional charges that must be paid by the client.

  • Late payments may result in extra charges such as rate increases or penalties for changes in bookings.

2.5 Cancellation Policy

  • Cancellation by the Client: Payments made are non-refundable. If the client cancels the trip, they will not recover the money already paid. If the client has travel insurance, they can manage a refund directly with the insurer.

  • Cancellation by Lúmina Travel:

    • Lúmina Travel may change the departure date or terminate the trip, always seeking the client’s convenience.

    • In case of cancellation by Lúmina Travel without justification, the money will be refunded (except for the costs of services already provided).

    • In the event of force majeure, no refunds will be given (see Section 4. Limitation of Liability).

3. Client Responsibilities

3.1 Documentation

  • The client is responsible for ensuring that all required travel documents (passports, visas, medical certificates, etc.) are in order.

  • Lúmina Travel is not responsible for issues arising from incomplete or incorrect documentation.

3.2 Travel Insurance

  • Recommendation: Lúmina Travel strongly recommends purchasing travel insurance to cover medical emergencies, cancellations, lost luggage, and other unforeseen events.

  • Insurance Management: Lúmina Travel offers the possibility to purchase travel insurance through its partners, ensuring adequate coverage.

  • If insurance is not purchased, Lúmina Travel will not be liable for any loss or expense not covered by insurance.

3.3 Conduct at Destination

  • The client must comply with local regulations and behave responsibly during the trip. If the client's behavior causes inconvenience, Lúmina Travel may terminate the agency-client relationship and will not cover any expenses arising from such termination.

3.4 Itinerary Review and Confirmation

  • The client must carefully review the itinerary and confirm their approval within 7 days of receiving it.

  • If the client notices any errors, they must notify Lúmina Travel within the specified period. If no notification is made, it will be considered that the client accepts the provided terms.

4. Limitation of Liability

Lúmina Travel acts as an intermediary between the client and the travel service providers. It is not responsible for the services provided by third parties, such as delays, cancellations, or accidents.

4.1 Force Majeure

  • Lúmina Travel will not be liable for failure to provide contracted services due to force majeure, including natural disasters, pandemics, war conflicts, and others.

  • If a force majeure event occurs, Lúmina Travel will offer viable alternatives based on the providers, but will not be liable for additional costs or refunds.

4.2 Financial Liability Exemption

  • Lúmina Travel will provide assistance, but any additional costs generated by changes or modifications during the trip must be borne by the client.

5. Data Protection

  • Lúmina Travel will protect the privacy of the client’s data and will use it solely for trip management purposes, in accordance with its Privacy Policy.

6. Use of Photos and Videos Shared by the Client

  • By sharing visual content with Lúmina Travel, the client grants the agency the right to use it for promotional purposes unless stated otherwise.
